WHATSAPP OFFLINE AND THE VIOLATION TO THE NETWORK NEUTRALITY

On December 17th, 2015, the São Bernardo do Campo Criminal Court issued a judicial order determining the mobile phone operators to interrupt the data traffic to WhatsApp, blocking all functionalities in the whole national territory.
 
Being almost unanimity among Brazilian internet users (93% of the almost 100 million Brazilian internet users use WhatsApp), the decision was one of the most controversial involving the digital economy in 2015 and Almeida Advogados analyzed all arguments raised by the judge, based mainly in a wrong interpretation of the Brazilian Internet Civil Rights Act (“Marco Civil”) and drafted a newsletter to clarify the key issues.
